Thank you for choosing Smoke and Stone Concrete Artistry (“we,” “us,” “our”). By requesting a quote, placing an order, or working with us in any way, you agree to the Terms of Service below. Please read them carefully before moving forward with a project.

1. Orders & Confirmation

A project is considered confirmed when we receive both: (a) a signed quote or invoice, and (b) the required deposit. Lead time begins only after you have approved any drawings, templates, and finish selections in writing.

Any delay in your approvals, changes in scope, or site readiness can push back the schedule. We’re committed to doing the job right, not rushed.

2. Pricing & Payments

Pricing is based on size, complexity, finishes, site conditions, and installation requirements. All pricing will be listed on your quote or invoice.

  • Deposit: A non-refundable deposit (percentage or flat amount as listed on your quote) is required to start production.
  • Balance Due: The final balance, including any approved change orders, is due upon completion and before delivery or installation.
  • Payment Methods: We accept the payment methods listed on your invoice. Card payments may include a processing fee.
  • Late Payments: Overdue balances may incur storage fees and interest up to the maximum allowed by law.

3. Scope of Work

We will provide a written scope of work describing what we’re building, the approximate timeline, and what is included. This usually covers templating, fabrication, finishing, delivery, and installation of concrete countertops or related pieces as agreed.

You are responsible for:

  • Providing accurate information, measurements (if applicable), and access to the site.
  • Ensuring cabinets, framing, and supports are properly installed and level.
  • Coordinating plumbing, electrical, and other trades unless otherwise agreed in writing.

4. Delivery, Access & Installation

We will schedule delivery and/or installation once your project is ready. You agree to provide clear and safe access to the installation area, including stairs, doorways, and paths.

If the site or other trades are not ready on the agreed date, rescheduling fees and/or storage fees may apply.

5. Custom Work & Variations

All of our work is custom and handcrafted. Concrete is a natural, cement-based material and may show variations in color, tone, texture, bug holes, and overall appearance. These variations are normal and are not considered defects.

6. Warranty

We stand behind our craftsmanship. For a period of [insert warranty period, e.g., “one year”] from installation, we will repair or address manufacturing or installation defects in our concrete countertops at our discretion.

The warranty does not cover:

  • Normal wear and tear, stains, etching, or patina from daily use.
  • Damage from misuse, impact, heat, chemicals, or neglect.
  • Movement, shifting, or settling of structures, cabinets, or substrates.
  • Hairline surface cracks that do not affect structural integrity.

7. Cracking & Natural Behavior of Concrete

Concrete is tough, but it’s still a natural material. Small hairline cracks may appear over time due to normal shrinkage, temperature changes, or building movement. These are usually cosmetic and are not considered a defect or failure.

8. Changes, Cancellations & Returns

Because every piece is made to order, projects cannot be returned once production has started. Changes requested after confirmation may result in additional charges and timeline adjustments.

If you cancel a project after we’ve begun work, your deposit is non-refundable and you may be responsible for costs incurred up to that point.

9. Photos & Marketing

We may photograph your project before, during, and after installation. By working with us, you grant us permission to use these images for our portfolio, website, and marketing materials, without identifying your address unless agreed otherwise.

10. Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim relating to our products or services is limited to the amount you paid us for the specific project at issue. We are not liable for indirect, incidental, or consequential damages, including loss of use or lost profits.

11. Governing Law

These Terms are governed by the laws of the State of Kansas. Any disputes will be handled in the state or federal courts located in or serving Wichita, Kansas, unless otherwise required by law.

12. Changes to These Terms

We may update these Terms from time to time. The “Effective Date” at the top will reflect the latest version. Continued use of our website or services after changes means you accept the updated Terms.
